Probate/Estate Administration and Trust Administration

Probate (or estate administration) is a process most of us have heard of before. It is the process that occurs after a person dies and a court must ensure all of the person’s debts and expenses are paid and assets pass to the estate’s beneficiaries.  That said, not all property is subject to probate or governed by the probate process – some assets pass “outside of probate.”  The probate process in each state is different, but in general, Delaware and Pennsylvania probate takes at least one year, during which time assets may be tied up and undistributed to beneficiaries.  If you are an executor or personal representative, an experienced estate administration or probate attorney can help simplify and expedite the process.

At Elle Van Dahlgren Law, LLC, we understand that this is a difficult time when loved ones are grieving.  It is not ideal to have to handle your loved one’s estate at the same time, especially if your loved one did not communicate with you during his or her lifetime about what would be required.  Whether you need to probate your loved one’s estate, administer their estate without probate, or handle their trust, we take the stress out of the process and help you every step of the way to make sure the estate passes to the proper beneficiaries.

If you have a loved one who passed away, whether you are a beneficiary or the executor/personal representative, we would be happy to meet with you to discuss what is required to ensure beneficiaries or heirs receive their inheritance.  There is a limited time to take advantage of certain options to get assets to the proper beneficiaries.  Also, after a certain period of time, any person (including creditors) can become executor of your loved one’s estate.  Thus, it is important that you contact an experienced probate lawyer like Elle Van Dahlgren Law, LLC as soon as possible after your loved one’s passing to begin the process and ensure beneficiaries receive their inheritance promptly.
